Terms of Service

Introduction: These Terms of Service ("Terms") govern your use of the Encore Landscape Management internal application ("App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms may be updated from time to time without prior notice. Your continued use of the App constitutes your acceptance of any changes.

2. Use of the App

The App is provided for authorized internal and client use only. You agree to use the App only for its intended purpose and in compliance with all applicable policies and laws. You must not misuse the App or attempt to access areas for which you do not have authorization.

3. Intellectual Property

All content, features, and functionality of the App, including any software, graphics, and text, are the exclusive property of Encore Landscape Management or its licensors. No portion of the App may be reproduced or used without prior written permission.

4. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Encore Landscape Management disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Limitation of Liability

Under no circumstances shall Encore Landscape Management be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability in any claim related to the App shall not exceed the amount paid (if any) by you to use the App.

6. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. Upon termination, your right to use the App will immediately cease.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.
